Terms of use and subscriptions

Publisher and agreement

Sculptt is provided by Martin Haas, individual entrepreneur under the French micro-enterprise regime, SIREN 914 125 562. By using Sculptt, you agree to these terms and to Apple's Standard EULA, which governs the licence to the iOS app. If these terms conflict with the Standard EULA or mandatory law, the Standard EULA and mandatory law apply to the extent required.

Eligibility

You must be at least 13 to use Sculptt. If you are under the age at which you can validly consent or contract where you live, a parent or legal guardian must review and approve your use. In France, consent-based processing for a user under 15 requires the joint consent of the user and a holder of parental responsibility.

The service

Sculptt provides personalised abdominal workouts, nutrition tracking, meal-photo analysis, generated guidance and visual progress tracking. Features may evolve, and availability can depend on device compatibility, internet access, subscription status and third-party services.

Fitness and nutrition notice

Sculptt is intended for general fitness and wellness information. Body-composition, visual-score, calorie, portion and nutrient estimates are approximate. They are not medical diagnoses, clinical measurements or substitutes for advice from a qualified healthcare professional. Stop exercising and seek appropriate professional advice if you experience pain, illness or symptoms that concern you. Do not use meal analysis to identify allergens or make medical nutrition decisions.

Subscriptions

• Sculptt may offer weekly and annual auto-renewable subscriptions through Apple's In-App Purchase system.
• The price and currency shown before purchase are supplied by the user's App Store storefront. The annual plan is charged in one payment for the annual period. Any weekly equivalent shown for the annual plan is an informational calculation only and is not a weekly billing schedule.
• Payment is charged by Apple to the Apple Account when the purchase is confirmed. The subscription renews automatically for the same period unless cancelled according to Apple's displayed terms before renewal.
• Manage or cancel a subscription through Apple subscriptions. Deleting Sculptt or a Sculptt account does not automatically cancel the Apple subscription.
• Use Restore Purchases in Sculptt to look for an existing entitlement linked to the Apple Account.
• Refund eligibility is determined by Apple and applicable consumer law. You may submit a request through Apple's refund portal. Nothing in these terms excludes statutory refund, conformity, withdrawal or other consumer rights where they apply.

Acceptable use

Use Sculptt only for lawful personal purposes. Do not attempt to bypass subscription controls, interfere with the service, probe its security, automate excessive requests, upload content you have no right to use, or submit another person's image without an appropriate lawful basis and permission.

Your content and privacy

You keep your rights in photos and information you submit. You allow Sculptt and its service providers to process that content only as needed to provide, secure and support the requested service, subject to the Privacy policy. Do not submit information you do not want processed by the providers identified there.

Availability and responsibility

Sculptt aims to provide a reliable service but does not guarantee uninterrupted availability or that generated estimates will be exact. The app is used at your discretion. Any limitation of liability applies only to the extent permitted by law and does not limit liability or remedies that cannot legally be excluded, including mandatory consumer protections.

Ending use

You may stop using Sculptt at any time. Subscription cancellation, account deletion and app deletion are separate actions. See the Support page for each procedure. Sculptt may restrict access where reasonably necessary to protect users, prevent abuse, comply with law or respond to a material breach of these terms.

Questions and disputes

Contact martinhaas.pro@gmail.com first so the issue can be reviewed. No consumer mediator has yet been appointed. This status must be regularised before relying on a mediation clause. Consumers retain access to any competent authority, court or mandatory dispute-resolution process available under applicable law.

Changes

Material changes will be presented in an appropriate manner before they apply where required. Continued use does not waive rights that require separate consent.
